Saint Paul City Attorney Samuel Clark today (August 24, 2016) released the following statement regarding the Minnesota Supreme Court’s decision in First Baptist Church of St. Paul v. City of St. Paul:

“With today’s Minnesota Supreme Court decision, the city has maintained its ability to collect assessments through its right-of-way program,” said City Attorney Clark. “In other words, it’s not a question of if the city can collect assessments but how it goes about doing so.

“The Minnesota Supreme Court referred the matter back to the district court to resolve questions that weren’t answered during earlier proceedings. While litigation over these issues continues, the city will evaluate its right-of-way program with a focus on continuing to provide exceptional right-of-way services.”
