Creating Chapter 34A of the Saint Paul Legislative Code 

Saint Paul, MN — In a 5–2 vote, the Saint Paul City Council declined to place on the ballot a proposed question that, if approved by voters, would have given tenants the ability to make repairs, after providing notice to their landlord, of up to $500 or one-half month’s rent.  

Council Vice President Yang and Councilmember Kim voted to place the question on the ballot. Council President Noecker and Councilmembers Johnson, Jost, Coleman, and Bowie voted against placing it on the ballot.

The decision was based on legal concerns that the proposed right-to-repair ordinance regulates Building Code provisions established by the State. The City Council has a responsibility to ensure that ballot questions comply with applicable federal, state, and local laws, ultimately working toward solutions that enhance the lives of Saint Paul residents. The proposed right-to-repair language if passed by the Council in ordinance form, or approved by the voters, could not be amended or repealed within one year, raising concerns about how potential legal issues would affect implementation.  

The City Council could still consider a revised version of the ordinance that addresses the identified legal issues. Additionally, petitioners may submit another petition for consideration at the next general election.
