Complaint Investigation Process

The following information provides a brief overview of the Division’s investigation process pursuant to the City of Saint Paul Human Rights Ordinance Chapter 183.

Statute of limitations: A charge must be filed within one year from the date on which the alleged discrimination occurred.

Jurisdiction: HREEO investigates complainants of discrimination alleged to have taken place within the City of Saint Paul.

Attorney representation: Representation is optional, not required.

Definitions

The following definitions are provided to clarify key terms used throughout this webpage.

ComplainantThe individual who files a charge of discrimination.
RespondentThe individual or business against whom a charge of discrimination is filed.
Charge of Discriminationa formal, signed document filed with HREEO alleging that an individual or business has discriminated against an individual. This begins an investigation into the allegations.
Position StatementThe Respondent’s formal response to the charge of discrimination. The response generally includes any defenses and evidence that supports their position.
RebuttalThe Complainant’s formal response to the Respondent’s position. The response can be done in writing, verbally, through an interview, or both.  
DeterminationHREEO’s decision on a case based on an analysis of the evidence
Probable Cause or PCHREEO’s determination that it is more likely than not that a prohibited discriminatory practice occurred  
No Probable Cause or NPCHREEO’s determination that it is more likely than not that no prohibited discriminatory practices occurred
