What is the Tenant Protections Ordinance?

Effective May 14, 2026, the Tenant Protections Ordinance provides the following protections for renters in the City of Saint Paul:

  • Screening guidelines
  • Security deposit and pre-paid rent limitations
  • Notice of sale, including a tenant protection period and relocation assistance
  • Pre-eviction notice for nonpayment of rent

Who is covered by the Tenant Protections Ordinance?

The Ordinance applies to residential rental housing in the City of Saint Paul. The provisions in the Ordinance apply to affordable and market rate housing, as summarized in the table below. Affordable housing is a unit that rents for no more than one-third of 60% or below area median income. A building is considered affordable if at least 20% of the units are affordable housing.

Tenant Screening Guidelines

The Tenant Screening Guidelines policy ensures fair access to housing by creating uniform guidelines related to the use of rental, criminal and credit history in applicant screening.

  • Property owners must use uniform screening criteria. They must provide this criteria to applicants before accepting an application, application fee, security deposit, or other fee for rental housing. 
  • Application fees must not exceed the cost of the screening process. Written information on the actual cost of the screening process must be made available to the applicant or to a tenant upon request.

The screening criteria below defines what can and cannot be used to deny applicants. 

Security Deposit Limitations

The Security Deposit Limitation policy ensures equitable access to housing by limiting upfront charges related to security deposits and prepaid rent.

Rules to Remember

  • Security deposit limit: Owners may not demand, charge, retain or accept from a renter a security deposit in an amount that exceeds a single month’s rent. See exception.
  • Prepaid rent limit: Owners may not demand, charge, retain, or accept from a renter prepaid rent that exceeds a single month’s rent. See exception.

Exceptions

If a rental application could be denied, an owner may request an additional single month’s security deposit or prepaid rent amount as a condition of approval.

This policy does not prevent an owner from charging a pet deposit or rental application fee. 

Affordable Housing: Notice of Sale Requirements

Notice of sale requirements support the preservation of housing that serves low- and moderate-income residents. This policy aims to provide stability and transparency to renters for changes that may affect their housing.

New property owners must notify their tenants after taking ownership of an affordable housing building, including a three-month tenant protection period. Affordable housing buildings are defined as any rental housing building where at least 20% of the units are affordable housing units. The definition for Affordable Housing Units is updated annually by the federal government.  
 

Pre-Eviction Notice Period Temporarily Extended to 60 Days

Property owners must provide 60-day notice before an eviction can be filed. This temporary protection is in place from May 14, 2026 through December 31, 2026. On January 1, 2027, the pre-eviction notice period will return to 30 days, in keeping with the Tenant Protections Ordinance. 

The notice must include:

  1. The total amount due;
  2. A specific accounting of the amount of the total due from unpaid rent, late fees, and other charges under the lease/rental agreement;
  3. The name and address of the person or online location authorized to receive rent and fees on behalf of the landlord;
  4. The following statement: "You have the right to seek legal help. If you can't afford a lawyer, free legal help may be available. Contact Legal Aid or visit www.LawHelpMN.org to know your rights and find your local Legal Aid office.";
  5. The following statement: "To apply for financial help, contact your local county or Tribal social services office, apply online at MNBenefits.mn.gov or call the United Way toll-free information line by dialing 2-1-1 or 800-543-7709."; and
  6. The following statement: "Your landlord can file an eviction case if you do not pay the total amount due or move out within 60 days from the date of this notice."

The Saint Paul City Council passed the ordinance temporarily extending the pre-eviction filing notice period on March 25, 2026
